Trade Practices Amendment (Australian Consumer Law) Bill

The Trade Practices Amendment (Australian Consumer Law) Bill has been introduced into Federal Parliament.  It aims to strengthen the legal framework around the creation of contracts, and strengthen the law against unfair contracts.The Australian Parliamentary Library have produced a background briefing paper " Trade Practices Amendment (Australian Consumer Law) Bill 2009" by Paula Pyburne.

National Consumer Credit Protection Bill

The National Consumer Credit Protection Bill  has passed through the Federal Parliament and is now awaiting final passage through the Senate.  It will replace the the state based Uniform Consumer Credit Code.

The Australian Parliamentary Library have produced a background briefing paper " National Consumer Credit Protection Bill" by PaoYi Tan.

This Bill is part of a package of three bills to implement a national consumer credit regime.  The Bill will:

  • establish a licensing regime for persons who engage in credit activities through an Australian Credit Licence that will be administered by the Australian Securities and Investments Commission;
  • apply conduct obligations on licensees;
  • establish a civil penalty and consumer remedy framework; and
  • provide consumer access to a three-tiered dispute resolution process for credit issues.
